New state of emergency - January 2021. What to do as a real estate consultant or agency open to the public?
The rules for this new state of emergency (starting on January 15, 2021) are similar to those we had in March and April last year.
Real estate agencies are legally prohibited from opening to the public. However, there is nothing to prevent the maintenance of the activity, in the establishment, behind closed doors, being naturally prohibited any type of commercial work in the store.
We will now analyze by parts what to do in relation to CPCV’s, Deeds, Assessments, Visits, Referrals and Reservations. I advance in advance that it is perfectly possible to continue the activity of real estate brokerage. We will only have to make some adaptations to traditional work processes.
Is it possible to carry out CPCV’s and Deeds?
One of the exceptions to the general duty of confinement is “participation in procedural acts with judicial bodies or in acts within the competence of notaries, lawyers, solicitors or registration officers”.
Whether a CPCV or a Deed is an act within the legal competence of notaries, lawyers, solicitors or registration officers and since their activities are legitimate, it is perfectly possible to displace people to carry out these acts.
Is it possible to carry out property appraisals?
Apparently it is perfectly possible for expert evaluators to carry out their activity. Nothing prevents the visits made by the expert appraisers to the properties to be maintained, as long as they respect the rules of social distance, use of a mask, hand disinfection and ventilation. If, on the one hand, there is no express prohibition on these service provision activities, nor does this act constitute an “opening to the public of establishment” of service provision, the truth is that work travel continues to be permitted, provided that it is not teleworking is possible. Therefore, it was concluded that the travel of expert appraisers to carry out visits to properties - preferably without the presence of the client - for property evaluation is not prevented.
How to make visits to properties?
Using traditional work processes it will not be possible. However, virtual visits is perfectly possible. During the first state of emergency in March and April 2020, we integrated video conferencing software into the DAI platform in order to allow virtual visits.

With this tool it is perfectly possible to continue the activity of visits to properties. However, for this to be possible, the real estate consultant will have to make an effort to re-educate the owners and visitors.
This is perhaps one of the points that will matter most for the resilience of the activity.
Is it possible to conduct door-to-door fundraising?
Using traditional work processes it will not be possible. However, it is perfectly possible to make the door-to-door in digital format. The activity of raising real estate is the driving force of our activity and without pursuing it, our business is placed in question.
After the March and April 2020 confinements we realized that it was necessary to do something about it. The result was the implementation on the DAI platform of digital door-to-door .
